Joustout, operated by Vich Technologies LLC ("we," "us," or "our"), respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform.

2. Information We Collect
2.1 Information You Provide
- Account Information: Phone number (required for signup, verified via OTP), email address (required after signup, verified via OTP), username (required), arena name (required), and optional profile details like profile picture.
- Content: Duels you create, arena information, comments, votes, chat messages, and any content you post or stream.
- Payment Information: Processed through Stripe. We do not store your full credit card details.
- Communications: Messages you send to support or other users through the platform.
- Platform Usage: JCR (JoustOut Credit) consumption data, duel participation history, and streaming activity across all duel modes (MoD, BoT, and HvH).
2.2 Automatically Collected Information
- Usage Data: Information about how you use Joustout, including duels watched, participation, JCR consumption, and platform interactions.
- Device Information: Device type, operating system, app version, and unique device identifiers.
- Log Data: IP address, access times, pages viewed, and features used (for security and debugging purposes).
- Performance Data: Video quality metrics, connection stability, and error logs to improve service quality.
2.3 What Information Is Public vs. Private
Public Information (visible to other users):
- Username and profile picture
- Email address
- Arena name and customization
- Duel titles, descriptions, and settings (for public duels)
- Comments and chat messages in public duels
- Your role as moderator or jouster in duels
- Voting activity in duels you participate in
Private Information (not visible to other users):
- Phone number
- Payment information and transaction history
- JCR balance and package purchase history
- IP address and device information
- Private messages and support communications
- Stripe account details
Be mindful: Anything you post publicly (username, email address, comments, video content) can be seen by other users. Choose your username and email address carefully as they are publicly visible.
3. How We Use Your Information
- Provide, maintain, and improve Joustout services
- Manage your account and authenticate your identity
- Process JCR package purchases and deduct JCR in real-time during duel hosting
- Process ticket payments and distribute earnings to moderators (80% to moderator, 20% platform fee)
- Enable live streaming, recording, and replay features across all duel modes (MoD, BoT, HvH)
- Communicate with you about your account, updates, security alerts, and support
- Detect, prevent, and address technical issues, fraud, and abuse
- Enforce our Terms of Service and community guidelines
- Analyze usage patterns to improve platform features and user experience
- Comply with legal obligations and respond to law enforcement requests
4. How We Share Your Information
Joustout will not share or sell any of your personal data.
We may share information only in the following limited circumstances:
- Payment Processing: Payment information is shared with Stripe to process transactions and distribute moderator earnings. Stripe's Privacy Policy governs their use of your information.
- Service Providers: We use third-party services (Firebase for data storage, LiveKit for video streaming, Amazon S3 for video storage) that may process your data on our behalf under strict confidentiality agreements. These providers cannot use your data for their own purposes.
- Legal Requirements: We may disclose information if required by law, subpoena, court order, or government request.
- Safety & Security: To protect the rights, property, or safety of Joustout, our users, or the public (e.g., preventing fraud, investigating abuse).
- With Your Consent: We may share information with your explicit consent for specific purposes you authorize.
5. Third-Party Services
Joustout uses the following third-party services to operate:

6. Data Retention
- Account Data: Retained as long as your account is active.
- Payment Records: Transaction records are maintained for tax and accounting purposes. Idempotency records (used to prevent duplicate charges) are automatically deleted after 30 days.
- Recorded Videos: Stored in Amazon S3 until deleted by the moderator or until the moderator's account is deleted.
- Deleted Accounts: When you delete your account, all associated data is permanently removed within 30 days, including: personal information (phone, email, profile), all duels and recordings, arenas, tickets, and chat history.
- Legal Holds: We may retain information longer if required by law or to resolve disputes.
7. Cookies & Tracking Technologies
Joustout currently does not use cookies, advertising trackers, or third-party analytics for marketing or behavioral tracking purposes.
Future Use: If we implement cookies or analytics in the future, we will:
- Update this policy with specific details
- Provide you with notice and the ability to manage your preferences
- Only use strictly necessary cookies without consent; all others require your opt-in
Do Not Track: Joustout does not currently respond to "Do Not Track" (DNT) browser signals, as there is no industry-wide standard for DNT compliance. We do not track your activity across third-party websites.
8. Your Privacy Rights
8.1 General Rights (All Users)
- Access: You can view and download your account information anytime in the app.
- Edit: You can update your profile, email, and account settings at any time. Your phone number cannot be changed once set during registration.
- Delete: You can permanently delete your account and all associated data through Settings.
- Data Portability: Contact us to request a machine-readable copy of your data.
- Object to Processing: You can object to certain uses of your data by contacting us.
- Withdraw Consent: Where we process data based on consent, you can withdraw consent at any time.
8.2 U.S. State Privacy Rights
If you are a resident of California, Virginia, Colorado, Connecticut, or Utah, you have additional rights under state privacy laws:
- Right to Know: You can request details about the personal information we collect, use, and share about you.
- Right to Delete: You can request deletion of your personal information (subject to legal exceptions).
- Right to Correct: You can request correction of inaccurate personal information.
- Right to Opt-Out: You can opt out of the "sale" or "sharing" of personal information. We do not sell or share your personal information.
- Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

Our legal basis for processing your data includes: performance of a contract (providing Joustout services), legal obligations, and legitimate interests (improving our services, preventing fraud).
9. Communication Preferences
- Service Communications: We may send you emails about your account, security alerts, payment confirmations, terms changes, and essential platform updates. You cannot opt out of these essential communications.
- Marketing Communications: If we send promotional emails in the future, you can opt out by clicking "unsubscribe" in any marketing email.
- Push Notifications: You can manage push notification preferences in your device settings.
10. Children's Privacy (COPPA Compliance)
Joustout is intended for users aged 13 and older. We do not knowingly collect personal information from children under 13.
- If we learn we have collected information from a child under 13, we will delete it immediately.
- If you believe we have collected information from a child under 13, please contact us immediately at support@joustout.com.
- Parents or guardians can request access to, correction of, or deletion of their child's information by contacting us.
11. Data Security
We implement reasonable security measures to protect your information, including:
- Encryption: All data transmitted between your device and our servers uses HTTPS/TLS encryption.
- Secure Storage: Server-side credentials and sensitive data are encrypted at rest.
- Authentication: Firebase token authentication protects API access.
- Access Controls: Limited employee access to personal data on a need-to-know basis.
- Monitoring: We monitor for security threats and unauthorized access.
- Regular Audits: Periodic security assessments of our infrastructure.
Important: No method of transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
12. International Data Transfers
Joustout operates in the United States. Your information may be transferred to, stored in, and processed in the United States or other countries where our service providers operate.
- These countries may have data protection laws different from those in your country.
- By using Joustout, you consent to the transfer of your information to the United States and other countries.
- For users in the EEA, we rely on appropriate safeguards such as Standard Contractual Clauses for data transfers.
13. Business Transfers
If Vich Technologies LLC is involved in a merger, acquisition, bankruptcy, reorganization, or sale of assets, your information may be transferred to the acquiring entity.
- We will notify you via email and/or prominent notice on the platform before your information is transferred.
- The new owner will be required to honor the commitments in this Privacy Policy.
- If the new owner's privacy practices differ, you will have the option to delete your account before the transfer.
14. Data Breach Notification
In the event of a data breach that affects your personal information, we will:
- Investigate the breach and take immediate steps to secure our systems
- Notify affected users via email within 72 hours of discovering the breach
- Provide details about what information was affected and what steps we're taking

- The "Last Updated" date at the top will reflect when changes were made.
- Continued use of Joustout after changes take effect constitutes acceptance of the updated policy.
- If you don't agree to the changes, you should stop using Joustout and delete your account.
16. Your Responsibilities
To help protect your privacy:
- Keep your password secure and don't share your account credentials
- Log out of your account when using shared devices
- Be mindful of what personal information you share publicly in duels, chats, and your profile
- Remember that your email address is publicly visible to other users
- Review your privacy settings regularly
- Report any suspicious activity or security concerns immediately
